Rep. Filler joins bipartisan effort to support survivors of sexual assault

State Rep. Graham Filler is sponsoring a bipartisan plan to better support sexual assault survivors and bring their abusers to justice.

Filler’s legislation is part of ongoing efforts to improve the system in response to shortcomings uncovered by the investigation into assaults committed by Larry Nassar. The latest proposals would improve standards related to retention of medical records and sentencing guidelines and provide more consequences for those who break the law.

Specifically, Filler’s House Bill 4123 prohibits using one’s professional position of authority over another person to prevent that person from reporting criminal sexual conduct or child abuse.

“It takes an incredible amount of courage for sexual assault survivors to disclose what they have endured,” Filler said. “Sadly, some survivors who come forward are encouraged to keep quiet, or the person they tell fails to follow the proper procedures and the abuse continues. When survivors speak up, we must make sure they are supported and that abusers are brought to justice.”

Other measures would require the permanent loss of a medical license for someone convicted of sexual misconduct under pretext of medical treatment, provide sentencing guidelines for physicians intentionally failing to maintain certain medical records, prohibit schools from expelling or suspending a student who reports being a victim of sexual assault, and require distribution of training materials to mandatory reporters of suspected child abuse or neglect.

House Bills 4120-25 have been referred to the House Judiciary Committee for consideration.
